Terms & Conditions
The General Conditions of Sale are applicable to every agreement between Your Garden Specialist and the other party. When the other party places an order, it accepts the General Conditions of Sale. Deviating from the Conditions of Sale can only be done with written agreement from YGS and after approval has been reached. The Conditions of Sale respect the rights of the consumer according to generally applicable Dutch consumer law.

3. SPECIAL OFFERS/AGREEMENTS
An agreement is established upon acceptance of your order. After payment of the order by the other party, YGS is within its rights to refuse or modify an order, or to attach conditions to the content of the agreement, the mode of delivery, etc. YGS is obliged to inform the other party of this within 10 (business) days, stating the reasons, and to offer the other party the opportunity to accept the change to the order or to declare the agreement invalid.
4. PRICES AND SHIPMENT
All prices include VAT. Gift vouchers are not included in the calculation of shipping costs. For orders less than $100 is the shipping fee €5,00 inside of the Netherlands, inside of Europe €12,95, inside the USA €9,00. Orders over $100 have free shipping in Europe and the United States. For the rest of the world shipping cost you $15.
If the order contains natural products, YGS is committed as much as is possible to deliver the items ordered. If an item cannot be delivered due to a bad harvest, YGS will offer to replace the item.
6. RETENTION OF TITLE
Ownership, and with it the rights of ownership, as well as obligations with respect to the items ordered are transferred only once physical delivery of the goods to the other party has taken place. Until that time, YGS has a duty of care with respect to the items ordered by the other party.
7. COMPLAINTS, LIABILITY AND RESPONSIBILITY
If your product arrives damaged, please contact customer service at email@example.com and a claim will be initiated with the carrier. You will need to retain the package(s) for a minimum of 14 days, as we and the parcel company may want to inspect the damaged product.
We will reship the damaged replacement product after the delivering carrier has approved the damage claim and product has been returned back to our warehouse. If we are currently out of stock of that item, we will gladly offer a substitute, or you may wait until the next shipping season for your area. We are not responsible for shipping delays or damage in shipment. We will not honor claims that are made more than 24 hours after receipt of the damaged product. After expiry of the terms mentioned above, customer is deemed to have approved the products delivered. For any concerns about your order, please contact us at firstname.lastname@example.org.
Note: We take full responsibility for the gardening success elements within our control. Since we have no control over the weather, critters, sunlight, moisture and similar regional factors that may impact the growth of plants in your garden, we cannot guarantee that your bulbs and plants will grow under any and all conditions.
The other party is responsible for the correct use of the delivered goods. YGS is not liable for any negative outcomes due to injudicious, improper or incorrect use or misuse of items delivered.
8. CHANGES TO AN ORDER
Once an order has been placed, please submit any changes at email@example.com. Sorry, but due to logistical reasons we cannot make changes to an order less than 14 days before your order will be shipped from Holland.
9. PACKAGES NOT RECEIVED
If the package is not received, for reasons other than incorrect address details, the order will be re-sent, if possible and desirable, in that same year, and otherwise the year after. No refunds will be given, only redelivery. Delivery out of the USA is at the risk of the other party.
10. PROTECTION OF PERSONAL DATA
To accept your order and to offer you the best possible service, we need some personal details from you. These details will be treated confidentially according to Dutch and European legislation, and will never be distributed to third parties.
11. ORDER CANCELLATIONS
Please contact us as soon as possible if you wish to cancel your order. We must receive your request at least 2 weeks (14 days) before your order will be shipped from Holland and a cancellation fee of $25 dollar will apply. Request to cancel orders less than 14 days prior to your requested delivery date will not be accepted and the order will be delivered as scheduled.
We give no warranty, expressed or implied, as to description quality, productiveness or any other manner of any seeds, bulbs or plants we sent out, nor will we be in any way responsible for the crop.
Should you wish to exercise your right of withdrawal, you must notify us within 24 hours after receipt of the items. This can be done by email, our contact form or our Social Media. We can then proceed to redeliver the same items, provide a voucher for the identical amount or refund the purchase price. You must return the items to us within 7 days of receipt.
